1.How this Privacy Policy applies

This Privacy Policy applies to the following products and services operated by MOTIFF PTE. LTD. (hereafter “us”, “we” or “our”):

  • Websites, including motiff.com and the mobile-optimized versions of these websites (“Websites”),
  • Mobile applications (“Apps”) on the iPhone, the iPad, and mobile devices operating with the Android OS and other operating systems, and
  • All other products, services, websites and/or applications which reference this Privacy Policy in a link or otherwise, (collectively referred to as “Products and Services”).

In connection with our Products and Services, some of the information you provide may be personal data. Personal data refers to the data of an individual, whether true or not, who can be identified (a) from that data; or (b) from that data and other information to which the collecting organization has or is likely to have access to ("Personal Data"). Also, some information we may collect may be non-personal data (“Non-Personal Data”). You are responsible for ensuring the accuracy of the Personal Data you provide to us. Inaccurate information may affect your use of our Websites, Apps and other Products and Services.

This Privacy Policy applies to all Personal Data and Non-Personal Data that you provide to us, or that we may collect about you. Please do not provide any such information to us if you do not accept this Privacy Policy. Should you notify us that you do not accept this Privacy Policy, please note that we may only be able to provide you with limited access to our Websites, Apps, Products and Services.


2.Non-Personal Data

We may collect Non-Personal Data, i.e., information that cannot be used to identify you or any particular person, whether on its own or with other information that we have or are likely to have access to. Non-Personal Data may also include web browser types, domain names and other anonymous statistical data created by aggregating user information collected through the use of our Website. Non-Personally Identifiable Information is used to help us better understand the characteristics of the individuals or businesses that may use our Products and Services. We use the information collected and aggregated to improve and market our Product and Services to you, and other individuals or businesses. A.Cookies

Our Websites use cookies to distinguish you from other users of our Websites. Cookies are pieces of information that a Website transfers to a user's hard drive for record-keeping purposes. We may also collect website traffic and statistical data, including but not limited to your browsing actions and patterns, individually or in the aggregate, for the purposes of system administration, processing, and related analysis. Such information assists in increasing efficiency when you browse our Website and enables us to improve our Websites for a better user experience.

B.Third-Party Websites or Advertisers

Data about your visits to, and activity on, our Websites, IP address, as well as the number of times you have viewed an advertisement, may be collected and used to display on your device screen customized advertisements that may be of particular interest to you.

As such, we disclaim liability for any loss, damage, and any other consequence resulting directly or indirectly from or relating to your access to any third-party website, or any error, omission, or misrepresentation on any third-party website.

C.Use of Non-Personal Data

The paragraphs described above outline how we collect and some of our uses of Non-Personal Data. We may also use Non-Personal Data to help us monitor the number of people using our Websites and selected sponsors' and advertisers' sites, to provide enhanced functionality on the Websites (e.g., user ID and password prompts, navigation aids, and session timers), to help us generate and deliver advertising, marketing and content on web pages, to monitor any other Website activity (e.g., user- agent, last URL requested by the user, client-side and server-side clickstream, age restrictions), and for functions related to the foregoing.

We collect Personal Data when you use our Products and Services, or when you visit our Websites, or download our Apps and provide us with such Personal Data. Such Personal Data includes, but is not limited to:

  • Solutions, products and/or services ordered and delivered
  • Your user profile including your username and password

  • Transmitting to any unaffiliated third parties including our third-party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for any of the aforementioned purposes; and any other incidental business purposes related to or in connection with the above.We may combine your Personal Data with other information. By using our Products and Services, visiting our Websites, downloading our Apps and sharing your Personal Data with us, you agree that we may disclose your Personal Data:
  • Where such disclosure is required for performing obligations in the course of or in connection with our provision of the Products and Services requested by you; and
  • To our affiliates, representatives and personnel, contractors we have engaged to perform any of the Purposes listed above.

Provision of your Personal Data is voluntary. However, if you do not provide us your Personal Data, provide insufficient or inaccurate Personal Data, or decline to provide Personal Data that we require, we may not be able to provide you with access to the Products and Services that you have requested, or use your Personal Data for the Purposes set out above.

The Purposes listed above may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

C.Withdrawing Consent

The consent that you provide for the collection, use and disclosure of your Personal Data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your Personal Data for any or all of the Purposes listed above at any time by submitting your request in writing or via email to us at service@motiff.com.

Upon receipt of your written request to withdraw your consent, we may require reasonable time to process your request and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within thirty (30) business days of receiving it.

Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing you with access to our Websites, Apps, Products or Services and we shall, in such circumstances, notify you of the same before completing the processing of your request. Should you nevertheless decide to cancel your withdrawal of consent, please inform us in writing or via email at service@motiff.com.

Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Data where such collection, use and disclosure without consent is permitted or required under applicable laws.

D.Accuracy of Personal Data

We work to ensure that Personal Data is accurate, complete and reliable for its intended use. Where the Personal Data is provided directly by you, we will presume that such Personal Data is accurate, complete and reliable for the purposes for which it was collected. You are responsible for ensuring the accuracy of the Personal Data you provide to us. Inaccurate information may affect the effectiveness of our Products and Services being used by you. We may from time-to-time request that you update the Personal Data submitted to us. Apart from such requests, you may, access and correct Personal Data that is in the possession or under our control at any time and as set out in this Privacy Policy.

E.Data Contained in Correspondence

This Privacy Policy does not apply to any content, business information, ideas, concepts or inventions, other than Personal Data, that you send to us in any correspondence (including by mail or email). We retain all such information contained in your correspondence. If you want to keep any content, business information, ideas, concepts, or inventions private or proprietary, do not send them in any correspondence to us.

F.Retention of Personal Data

We will retain your Personal Data for as long as it is necessary to fulfil the Purposes for which it was collected, or as required or permitted under the applicable laws.

We will cease to retain your Personal Data, or remove the means by which the Personal Data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the Purposes for which the Personal Data was collected, and is no longer necessary for legal or business purposes.

G.Protection of Personal Data

Personal Data which is in our possession or under its control is kept on secure servers. We shall adopt commercially reasonable administrative, technical, personnel, and physical measures to (a) safeguard Personal Data against loss, theft, and unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks; and (b) ensure the integrity of the Personal Data. To help us protect your privacy, you should maintain the secrecy of any logon ID and password required from time to time (if any) which you may have set up in connection with your receipt and use of our Tools, Products and Services.

While we take reasonable precautions to safeguard your Personal Data in our possession or under our control, we cannot be held responsible for unauthorised or unintended access that is beyond our control, including hacking or cybercrimes. We also do not guarantee that our Websites and Apps are invulnerable to security breaches, or that your use of our Websites and Apps is safe and protected from viruses, worms, Trojan horses, and other vulnerabilities.

You should also be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. Notwithstanding, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

H.Anonymised Data

From time to time, we may collect Personal Data from you or others on your behalf under this Privacy Policy, and convert such Personal Data into anonymised (i.e., de-identified) data (“Anonymised Data”). Anonymised Data will not contain Personal Data or any information that can be used to identify you or any other person, whether alone, or in combination with other information that we have or are likely to have access to.

Anonymised Data may be used, stored transferred, disclosed, assigned, leased, licensed, sold and otherwise shared with and by our partners, service providers, advertisers and/or other third parties to help us in our business and operations and for purposes permitted under the law. To further protect you, we will take steps to ensure that any unauthorised attempt by such partners, service providers, advertisers and/or other third parties to cause a re-identification of Anonymised Data will be a breach of any agreement that it has entered with us.

I.Accessing and Correcting Your Personal Data

You may access and correct your Personal Data that is in the possession or under our control at any time. You may also request for a copy of such information. Please note that a reasonable fee may be charged for an access request or where a copy of your information is so requested. If so, we will inform you of the fee before processing your request. No fee is payable for any request to correct your Personal Data (including any incomplete or inaccurate information).

To access, review, correct, or remove your Personal Data or part thereof, please submit a request to us at: service@motiff.com. All requests must include the following information: first name, last name, and e-mail address. While we will try our best to accommodate your request, we reserve the right to reject or limit any such requests in accordance with the provisions of any applicable laws or regulations.

Unless we are satisfied on reasonable grounds that a correction should not be made, we shall correct the Personal Data as soon as practicable, and send the corrected information to every other organisation to which such information had been provided to, unless that other organisation does not need the corrected Personal Data for any legal or business purpose.

We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing of the time by which we will be able to respond to your request. If we are unable to accede to any request for access to or to correct any of your information, we shall generally inform you of the reasons why we are unable to do so (except where we are not required or permitted to do so under any applicable law or regulations).

J.Transfer of Personal Data to Other Countries

Personal or Non-Personal Data under this Privacy Policy may be transferred to various countries around the world that may have varying legal protections than your country. When transferring such information, we will require recipients of any information that include Personal Data to protect such information at a standard comparable to or better than that under the laws of your jurisdiction through legally enforceable agreements with the recipients. By using and/or accessing our Website, Apps and other Products and Services, or providing us with your Personal Data, you consent to the collection, transfer, storage, and processing of information to and in the United States.


4.Subprocessors

To support delivery of our Products and Services, we may engage and use data processors with access to certain Personal Data and Non-Personal Data (each, a "Subprocessor"). This article provides important information about the identity, location and role of each Subprocessor.

A.Third Parties

We currently uses third party Subprocessors to provide infrastructure and other services, and to help us provide customer support and email notifications. Prior to engaging any third party Subprocessor, we perform diligence to evaluate their privacy, security and confidentiality practices, and executes an agreement implementing its applicable obligations.


5.Minors

The Products and Services are not directed to children under 18 (or other age as required by local law), and, except for limited circumstances set forth below, we do not knowingly collect personal information from children. If you learn that your child has provided us with personal information without your consent, you may contact us as set forth below. If we learn that we have collected a child’s personal information in violation of applicable law, we will promptly take steps to delete such information and terminate the child’s account, or, if appropriate and possible, seek written consent from such child’s guardian.


6.Modifications to this Privacy Policy

The provisions contained in this Privacy Policy supersede all previous notices or policies regarding our privacy practices with respect to our Website, Apps and Products and Services.

We reserve the right to change, add or remove terms of this Privacy Policy for any reason and at any time without notice to you other than by posting revisions accessible to you and on our Website, Apps and Products and Services. Such changes will take effect immediately upon posting on our Website, Apps and Products and Services. You should check our Privacy Policy periodically for any changes which have been made to it. Your continued use of our Websites, Apps and Products and Services owned and operated by us, and provision of any Personal Data or any other information in respect thereof constitutes your binding acceptance of such changes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE IN ANY EVENT FOR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND OR FOR ANY LOSS OF REPUTATION OR GOODWILL, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), EQUITY, STRICT LIABILITY, STATUTE OR OTHERWISE, SUFFERED AS A RESULT OF UNAUTHORISED OR UNINTENDED USE, ACCESS OR DISCLOSURE OF YOUR INFORMATION (INCLUDING ANY PERSONAL DATA).
